On 3 April 2014, Directive 2014/41/EU regarding the European investigation order in criminal matters was finally approved. This instrument seeks to overcome the present fragmentary regulation on the gathering and transfer of cross-border evidence and improve the efficiency of the international judicial cooperation among the Member States. This article analyses the scope, content, and requirements of the European investigation order in order to make an assessment of this Directive from the point of view of the protection of the fundamental rights envisaged in Article 48 of the European Charter of Fundamental Rights, and, in particular, the right of defence in transnational criminal proceedings.

Today, crime pays! This is a familiar statement. Assets of criminals remain sheltered and their value is significant at both European and international levels. The capacity for criminals to enjoy the fruits of their criminal endeavours has the following three immediate economic consequences. First, crime does pay. Second, criminal activities will continue to perpetuate, as criminals are able to invest in the future by having the means to corrupt others and inspire those keen to emulate their well-rewarded achievements. Third, as criminals seek to launder the fruits of their activities and reinvest in the regular economy, they create market distortions, for they are unfair competitors not having borne the initial costs of doing business.

EHRM: Rusland verantwoordelijk voor schending EVRM bij MH17 en conflict in Oekraïne

Op 9 juli 2025 oordeelde het Europees Hof voor de Rechten van de Mens dat Rusland verantwoordelijk is voor het neerhalen van vlucht MH17 en voor ernstige mensenrechtenschendingen in Oekraïne sinds 2014. Het Hof stelde schendingen vast van onder meer artikel 2, 3 en 13 EVRM in verband met MH17, waaronder het recht op leven en het verbod op onmenselijke behandeling. Ook in het bredere Oekraïne-conflict achtte het Hof Rusland schuldig aan systematische schendingen van talrijke verdragsrechten. Ondanks het feit dat Rusland sinds 2022 geen lid meer is van de Raad van Europa, blijft het gebonden aan deze uitspraak voor feiten tot die datum. De procedure over schadevergoeding wordt later voortgezet.

Op 24 juni 2025 publiceerde de Europese Commissie haar langverwachte Roadmap for Lawful and Effective Access to Data for Law Enforcement. De roadmap beoogt opsporingsautoriteiten beter in staat te stellen om cybercriminaliteit en ernstige misdaad te bestrijden in een tijdperk waarin vrijwel elke misdaad een digitale component kent. De voorgestelde maatregelen zijn ambitieus: van standaardisering van data-toegang en verbetering van digitale forensische capaciteiten, tot gezamenlijke inkoop van opsporingstechnologie en het ontwikkelen van AI-oplossingen voor bewijsanalyse.

Corporate criminal liability in EU Directives: An overview of the EU discipline

This article focuses on the corporate criminal liability regime introduced by EU directives harmonising criminal law. Liability of legal persons has become an essential tool in preventing and sanctioning serious crimes and European criminal law has progressively developed a common approach. The more recent legal instruments adopted by the EU strengthen the obligation for Member States to adopt a common standard and minimise the risk of forum shopping. This paper aims to analyse the European Union’s approach to corporate liability, investigating the nature of such liability and its contents, by focusing in particular on the criteria for attributing this liability to entities and the sanction provisions. Recent EU legislative acts contain some crucial innovations that appear to go beyond the minimum standards and place more emphasis on the organisational fault of the corporation, as well as the post-delictum re-organisation.

EU Anti-Corruptie Richtlijn: stagnerend overleg, maar hoop op toekomstig succes

Op 11 juni 2025 vond in Brussel de vierde triloog plaats tussen het Europees Parlement, de Raad van de EU en de Europese Commissie over de voorgestelde EU Anti-Corruptie Richtlijn. Deze onderhandelingsronde bracht veel technische vooruitgang, maar eindigde zonder politiek akkoord. De belangrijkste discussiepunten draaiden om de strafbaarstelling van misbruik van functies, het niveau van minimumstraffen, de reikwijdte van klokkenluidersbescherming en de gewenste implementatietermijn voor de richtlijn.

In deze strafzaak, de eerste in Nederland waarbij het Europees Openbaar Ministerie (EOM) als vervolgende instantie optreedt, staat een natuurlijk persoon terecht die feitelijk bestuurder is van een vennootschap die betrokken blijkt bij een internationale btw-fraudeconstructie. De fraudeconstructie strekt zich uit over meerdere lidstaten van de Europese Unie en omvat onder meer Duitsland, Hongarije en het Verenigd Koninkrijk.
