The European Public Prosecutor: Quintessential supranational criminal law?

This article critically examines the extent to which the European Public Prosecutor’s Office can be claimed to constitute a prime example of supranational criminal law. The article observes that among policymakers and commentators, the Office appears to be a hallmark of the transformation of EU criminal law from an intergovernmental paradigm to a strong federal and supranational polity.

German Corporate Sanctions Law failed (for now)

After this development had been apparent for several months, the legislative project for a German corporate sanctions law has now failed; at least for this legislative period. Although the governing parties had already agreed on a “new sanctions law for companies” in the coalition agreement in 2018, and an “unofficial” draft bill was available in August 2019, which finally made it to a governmental draft in 2020 under the title “Law to Strengthen Integrity in Business”, the project has now (for the time being) failed after intensive discussions in recent months.

Artikel: Admissibility of Evidence in Criminal Proceedings in the EU

With the increase in volume and importance of cross-border investigations in the EU, ensuring the admissibility of evidence gathered in another Member State at trial is crucial − both for efficient law enforcement and for the protection of fundamental rights. At present, the rules on the collection, use, and admissibility of evidence are left to the laws of national criminal procedure of the Member States. These differ extensively as to the collection, use, admissibility, and nullity of evidence and thereby act as an obstacle to the use of cross-border evidence. In order to overcome the present difficulties, this article argues in favour of a new legislative proposal based on Art. 82(2) subsection 2 TFEU laying down common rules for the admissibility and exclusion of evidence in criminal proceedings.
