Artikel: Admissibility of Evidence in Criminal Proceedings in the EU

With the increase in volume and importance of cross-border investigations in the EU, ensuring the admissibility of evidence gathered in another Member State at trial is crucial − both for efficient law enforcement and for the protection of fundamental rights. At present, the rules on the collection, use, and admissibility of evidence are left to the laws of national criminal procedure of the Member States. These differ extensively as to the collection, use, admissibility, and nullity of evidence and thereby act as an obstacle to the use of cross-border evidence. In order to overcome the present difficulties, this article argues in favour of a new legislative proposal based on Art. 82(2) subsection 2 TFEU laying down common rules for the admissibility and exclusion of evidence in criminal proceedings.

Nieuwe EU-verordening om verspreiding van terroristische online-inhoud aan te pakken

Met een nieuwe verordening beoogt de Europese Unie te voorkomen dat terroristen het internet gebruiken om te radicaliseren, te werven en aan te zetten tot geweld en om hieraan gerelateerde inhoud op het internet snel te kunnen verwijderen via één gemeenschappelijk instrument voor alle EU-lidstaten. De regels van de verordening zullen van toepassing zijn op aanbieders van hosting¬diensten die actief zijn in de EU, ongeacht of ze hun hoofdvestiging in de EU-lidstaten hebben. Rechtshandhavers krijgen met de verordening een doeltreffend instrument om bijvoorbeeld in te kunnen grijpen wanneer online radicaliseringsactiviteiten plaatsvinden of terreuraanslagen worden gelivestreamd. Internet-bedrijven zullen sneller en efficiënter kunnen optreden in dergelijke situaties.

Verscherpte regels in werking voor controle van liquide middelen om witwassen en financiering van terrorisme tegen te gaan

De FATF constateerde in 2015 “Money laundering through physical transportation of cash” dat er nauwelijks (geharmoniseerde) controle is op het EU grensoverschrijdend vervoer van contant geld in vrachtzendingen (weg, lucht en maritiem) en via briefpost en pakketten. Dit geldt ook voor Nederland. Binnen de Europese Unie vindt overigens überhaupt geen controle plaats, er is vrij verkeer van personen en goederen. Deze constatering heeft er mede toe geleid dat per 3 juni 2021 nieuwe EU regelgeving in werking is getreden.

HvJ EU: aanhouding van door Interpol gesignaleerde persoon niet toegestaan wanneer Interpol-opsporingscirculaire is uitgevaardigd voor reeds berechte strafbare feiten

HvJ EU 18 mei 2021, C-505/19 (WS)

Een EU-lidstaat of een Schengenstaat mag een door Interpol gesignaleerde persoon niet aanhouden wanneer bij onherroepelijk vonnis is vastgesteld dat de opsporingscirculaire van Interpol is uitgevaardigd voor reeds berechte strafbare feiten. De gesignaleerde persoon mag wel voorlopig worden aangehouden om te kunnen verifiëren of de opsporingscirculaire betrekking heeft op reeds berechte strafbare feiten. De voorlopige aanhouding mag echter niet worden gehandhaafd wanneer na verificatie vast is komen te staan dat sprake is van reeds berechte strafbare feiten. Dat is het antwoord van het EU-Hof op vragen van een Duitse rechter.

Artikel: Refining Relations between the EJN, Eurojust and the EPPO

The article deals with the relations between the European Judicial Network (EJN), Eurojust, and the European Public Prosecutor’s Office (EPPO) , in particular the question of how to shape their relationship. Direct communication between Member States’ judicial authorities is the underlying principle of international cooperation in criminal matters in the EU. This needs to be reflected in the legal instruments covering international cooperation. Technical platforms for secure electronic communication between judicial authorities must be designed in such a way as to facilitate direct communication and should not lead to an enhanced role for central authorities.

Artikel: Addressing the Problems of Jurisdictional Conflicts in Criminal Matters within the EU

The current EU approach to jurisdictional conflicts is discussed in the first part of this article. The article highlights the persistent problems of the existing legal framework as well as those emanating from Eurojust’s approach to the matter. After linking the topic with the ne bis in idem principle, the Member States’ interests in prosecuting criminal offenses under their competence, and the EU’s objective in the AFSJ when fighting impunity, the author presents some pivotal reflections on a better solution in the second part. Any solution first and foremost has to respect the EU’s main characteristic as a supranational organisation aligned to its constitutional treaties and to its Charter of Fundamental Rights.

Europees Openbaar Ministerie per 1 juni operationeel

De Europese Commissie heeft officieel bevestigd dat het Europees Openbaar Ministerie (EOM) op 1 juni 2021 operationeel is. Het EOM heeft tot taak strafbare feiten die de EU-begroting schaden, strafrechtelijk te onderzoeken en te vervolgen. Het EOM is het eerste supranationale openbaar ministerie en is belast met het onderzoek en de vervolging van bepaalde soorten fraude en andere strafbare feiten die schade toebrengen aan de financiële belangen van de EU.

EHRM wijst klacht "luxleaker" af

EHRM 11 mei 2021, app. no. 21884/18 (Halet v. Luxembourg)

Luxleaker Halet heeft terecht 1.000 euro boete opgelegd gekregen voor schending van geheimhouding en diefstal van zijn werkgever PwC, zo oordeelt het Europees Hof voor de Rechten van de Mens (EHRM). Halet is een voormalig werknemer van PricewaterhouseCoopers (PwC) in Luxemburg. Enkele jaren geleden heeft hij documenten geopenbaard die zien op rulings gesloten door PwC t.b.v. allerlei Amerikaanse bedrijven, waaronder Apple, Amazon en Ikea.
