Door de nieuwe EU-regels wordt het voor criminelen moeilijker om met behulp van cryptoactiva de EU-anti-witwasregels te omzeilen. Volgens de nieuwe regels zijn aanbieders van cryptoactiva-diensten verplicht bepaalde informatie te verzamelen en toegankelijk te maken over de afzender en de begunstigde van de overmakingen van cryptoactiva. Overmakingen van cryptoactiva worden daardoor traceerbaar, zodat verdachte transacties beter kunnen worden opgespoord en zo nodig geblokkeerd.

The EPPO’s legislateve framework: Navigating through EU law, national law and soft law

The legal framework under which the European Public Prosecutor’s Office (EPPO) is called to operate is particularly complex, given the need for this body to exercise its functions in the legal systems of the Member States, applying both Union and national law. While this may justify the many references to national law contained in the EPPO’s founding Regulation (2017/1939), several among these references present relevant interpretative issues, and may in some cases even have a misleading effect. The article aims at showing examples of these different scenarios. It also touches briefly on the relevance of soft law in the legal framework of the EPPO.

HvJ EU oordeelt over het verstrekken van informatie over het recht op een nieuw proces bij verstekprocedures

HvJ EU 8 juni 2023, C-430/22 en C-468/22

Een nationale rechter die een beslissing bij verstek wijst tegen een afwezige niet-gelokaliseerde verdachte of beklaagde, is niet verplicht om in die beslissing informatie op te nemen over het recht op een nieuw proces en de mogelijkheid om de beslissing aan te vechten. De keuze van de nadere regels voor het verstrekken van die informatie behoort tot de bevoegdheid van de lidstaten, zolang die informatie maar aan de betrokkene wordt verstrekt op het moment dat hij in kennis wordt gesteld van die beslissing. Dat is het antwoord van het EU-Hof op vragen van een Bulgaarse rechter.

EU-scorebord met cijfers over corruptiebestrijding

Op 8 juni 2023 heeft de Commissie het EU Justice Scoreboard gepubliceerd. Het scorebord geeft een jaarlijks overzicht van de efficiëntie, kwaliteit en onafhankelijkheid van de rechtsstelsels van de lidstaten door objectieve, betrouwbare en vergelijkbare gegevens te verstrekken. Voor het eerst bevat het EU-scorebord voor justitie ook gegevens over corruptiebestrijding. Dit naar aanleiding van het recente voorstel voor corruptiebestrijding. Het scorebord bevat nieuwe indicatoren over de efficiëntie van strafrechtbanken van eerste aanleg in omkopingszaken, over de benoeming van nationale hooggerechtshoven en openbare aanklagers en openbare aanklagers en over de organen die betrokken zijn bij de preventie en repressie van corruptie.

Artikel: The relations between the European Public Prosecutor’s Office and the Member States that do not participate in the enhanced cooperation

The first of June 2021 marked the start of the operational activities of the European Public Prosecutor’s Office (EPPO). Established by Regulation (EU) 2017/1939 (‘EPPO Regulation’), the EPPO is the European Union body competent to investigate, prosecute and bring to judgment the perpetrators of criminal offences affecting the Union’s financial interests. The EPPO was established by means of enhanced cooperation. At the time of writing, five Member States do not participate in the EPPO: Denmark, Ireland, Poland, Hungary and Sweden. The effective action against crimes affecting the Union budget requires however smooth cooperation between the EPPO and its counterparts not only in the Member States that participate in the enhanced cooperation, but also in the non-participating Member States. This contribution delves into such cooperation and the several issues it raises, first providing for some introductory remarks on the choice of some Member States not to join the enhanced cooperation on the EPPO. It then analyses the two main provisions of the EPPO Regulation concerning the EPPO’s relations with non-participating Member States, Article 99 and, most importantly, Article 105. Finally, this contribution shortly addresses the relevant role played by Eurojust in this context.

Artikel: Admissibility of Evidence in EPPO proceedings

The issue of cross-border admissibility of evidence is a recurring theme of European Criminal Justice, and continues to be perceived as a decisive obstacle hindering the effective prosecution and adjudication of crime. In spite of this, the EPPO Regulation does not include an extensive framework guaranteeing the cross-border admissibility of evidence. In this article, it is argued that this lacuna is far less worrisome than it seems: the boundaries set out by EU primary law, in particular Article 325(4) TFEU and the Charter of Fundamental Rights (CFR), as well as the opportunity of the ECJ to judge on these boundaries, allow for a sufficient convergence of national laws and practices on the (in-)admissibility of evidence.

Wet voorkoming misbruik chemicaliën & Reikwijdte meldplicht

Hoge Raad 30 mei 2023, ECLI:NL:HR:2023:768

Dit betreft een OM-cassatie na vrijspraak wegens het niet voldoen aan de in art. 8 Verordening 273/2004 opgenomen plicht tot informatieverstrekking door geen melding te doen van het vervoeren/ontvangen/opslaan/voorhanden hebben van grote hoeveelheden drugsprecursoren (art. 2.a Wet voorkoming misbruik chemicaliën). Er waren prejudiciële vragen gesteld aan HvJEU. Het HvJEU heeft het begrip “marktdeelnemer” a.b.i. art. 2.d Verordening 273/2004 zo uitgelegd dat alleen personen die betrokken zijn bij het binnen legaal kader in de handel brengen van geregistreerde stoffen, kunnen worden beschouwd als “marktdeelnemer”. Een natuurlijke persoon of rechtspersoon die in kader van illegale activiteit is betrokken bij in handel brengen van in EU geregistreerde stoffen, is daarom geen “marktdeelnemer”. Dit brengt mee dat voor veroordeling wegens niet naleven van de meldplicht is vereist dat verdachte kan worden aangemerkt als “marktdeelnemer”. Dit te bewijzen bestanddeel kan niet worden bewezen verklaard als komt vast te staan dat verdachte in kader van illegale activiteit betrokken is bij in handel brengen van betreffende geregistreerde stoffen. Daarvan is in ieder geval sprake als verdachte m.b.t. geregistreerde stoffen gedragingen heeft verricht, die een in Opiumwet strafbaar gesteld feit opleveren.

An interpretative analysis of the European ne bis in idem principle through the lens of ECHR, CFR and CISA Provisions: Are three streams flowing in the same channel?

The ne bis in idem principle (procedural defence) proscribes multiple criminal proceedings and punishments for the same criminal offence/conduct, which is predicated on a final verdict of acquittal or conviction by a court of competent jurisdiction. Incorporated as a fundamental human right through Article 4 of Protocol No. 7 annexed to the ECHR and fundamental right safeguarded through Article 50 CFR, the principle is conjoined with the right to free movement of persons through Article 54 CISA. An evaluation of the characteristics, substance, rationale, scope, and limitations associated with the autonomous procedural defence reveals corresponding purposes. CJEU and ECtHR jurisprudence have delineated the scope and limitations of the procedural defence and the two European courts have reciprocally influenced their respective case law. Definitive and practical judicial guidelines on the application of the principle facilitate consistency of approach by diverse national legal systems consistent with the principle of legality.
