EHRM doet baanbrekende uitspraak over het horen van belastende getuigen (Keskin t. Nederland)

Het Europese Hof voor de Rechten van de Mens (EHRM) heeft een baanbrekende uitspraak gedaan in een zaak tegen Nederland. De Hoge Raad bepaalde dat de verdachte in deze zaak een verzoek, om een belastende getuige te horen, moet motiveren. Het EHRM neemt unaniem schending van artikel 6 EVRM aan, omdat de verdachte nimmer de belastende getuigen in zijn zaak heeft kunnen ondervragen.

In deze uitspraak beslist het ECJ dat het confisqueren (verbeurdverklaren) van een hulpmiddel dat toebehoort aan een derde die te goeder trouw is, in strijd is met het Europese recht. Bovendien is onrechtmatig dat het nationale recht niet voorzag in rechtsmiddelen ten gunste van deze derde.
