Naam verdachte rechtspersoon was in de ten laste gelegde periode van 1 augustus 2006 tot en met 7 september 2006 niet aan te merken als een Nederlandse rechtspersoon, zodat geen rechtsmacht bestaat op grond van het nationaliteitsbeginsel. Of sprake is van een rechtspersoon met de Nederlandse nationaliteit, moet worden beoordeeld aan de hand van de feitelijke vestigingsplaats van de rechtspersoon. Dat was voor naam verdachte rechtspersoon evident niet Nederland.
