Het nemo tenetur-beginsel en wils(on)afhankelijk materiaal in non-hard core punitieve procedures

De uitspraak van het EHRM in De Legé t. Nederland ziet op veelbesproken rechten (ook in de Straatsburgse rechtspraak), te weten het nemo tenetur-beginsel (en het zwijgrecht), zoals beschermd onder art. 6 EVRM. Klachten over deze rechten komen in verschillende constellaties voor. In De Legé gaat het grosso modo om dezelfde constructie die aan de orde was in de (niet-)ontvankelijkheidsbeslissing van het Hof in Van Weerelt t. Nederland. Kort gezegd gaat het er in deze constructie om dat de fiscus, om informatie te verkrijgen, naast door toepassing van de eigen vorderingsbevoegdheden, de weg bewandelt van de civiele rechter, om verstrekking van informatie via een dwangsom af te dwingen. In beide zaken ging het om informatie met betrekking tot door beide klagers bij buitenlandse banken gehouden vermogen.

HvJ EU: eenieder heeft het recht om te weten aan wie zijn persoonsgegevens zijn verstrekt

HvJ EU 12 januari 2023, C-154/21 (Österreichische Post)

Het in de AVG geregelde recht van een betrokkene om inzage te verkrijgen van de hem betreffende persoonsgegevens, brengt mee dat de verwerkingsverantwoordelijke verplicht is om aan de betrokkene de identiteit van de specifieke ontvangers van die gegevens mee te delen. Alleen wanneer het onmogelijk is om die ontvangers te identificeren of wanneer de verwerkingsverantwoordelijke aantoont dat de verzoeken om inzage van de betrokkene kennelijk ongegrond of buitensporig zijn, hoeft hij alleen de categorieën van de betreffende ontvangers mee te delen aan de betrokkene. Dat is het antwoord van het EU-Hof op een vraag van een Oostenrijkse rechter.

Noot: Een nieuwe episode in de dataretentiejurisprudentie

Dataretentievraagstukken veroorzaken een gestage jurisprudentiestroom. Onlangs heeft het Hof van Justitie van de EU (HvJ EU) de jurisprudentiële lijnen uit de richtinggevende arresten La Quadrature du Net en Prokuratuur nog eens bestendigd. In de ogen van advocaat-generaal Campos Sánchez-Bordona was de rechtsgang zelfs onnodig. Hij vond dat het HvJ EU de hier aan de orde zijnde vragen reeds ‘afdoende’ had beantwoord. Het Ierse Supreme Court had weliswaar van de eerdere uitspraken kennisgenomen, maar zich daarover ‘nogal laconiek’ uitgelaten en toch aangedrongen op een nieuwe prejudiciële beslissing, aldus de A-G. De vraag is of hij met die stellingname niet te kort door de bocht is gegaan. Weliswaar waren de door het Ierse Hof geformuleerde vragen niet nieuw, het onderhavige arrest biedt op een onderdeel wel degelijk een nadere precisering van bestaande jurisprudentiële lijnen. De uitspraak biedt evenwel geen blauwdrukken voor wetgeving en roept dus, net als de eerdere uitspraken, vragen op over de implementatie ervan in de Nederlandse context.

Eerste stappen gezet in een EU-VS Data privacy raamwerk

Door het opstellen van een zogenoemd ontwerp adequaatheidsbesluit heeft de Europese Commissie medio december 2022 het startsein gegeven voor het vaststellen van dat besluit voor een EU-VS-kader voor gegevens privacy. Dat kader moet veilige trans-Atlantische gegevensstromen bevorderen en tegemoet komen aan de bezorgdheid die het Hof van Justitie van de Europese Unie medio 2020 in de Schrems II-kwestie in heeft geuit.

Artikel: The Players in the Protection of the EU’s Financial Interests

Cooperation between authorities conducting administrative investigations and those conducting criminal investigations at both the EU and Member State levels is essential to ensure a high level of protection in view of the EU's financial interests. However, the legal framework governing the role and competences of individual authorities at the EU level seems much clearer than the corresponding national legal frameworks of the Member States. Indeed, at the Member State level, the legal frameworks for conducting investigations, whether administrative or criminal, significantly differ from Member State to Member State. Likewise, there is no clear legal framework at the EU level that defines and sets standards regarding the mandatory control mechanisms that must be established at the level of the entire system for the protection of the EU’s financial interests in the Member States. This also applies in relation to the players that need to be involved in the protection of the EU's financial interests. The article tackles the issue of the necessity to harmonise both criminal and administrative legislation at the level of Member States as well as the need for a clear definition of which players should be involved in the protection of the EU budget.

The European Commission and the European Public Prosecutor’s Office (EPPO) have a joint interest in effectively fighting, and mitigating the effects of, crimes against the EU’s financial interests. In 2021, they concluded an agreement to translate this mutual interest into concrete cooperation measures. Their cooperation is unique in the EU’s anti-fraud architecture, having regard to the Commission’s specific responsibility for managing and protecting the EU budget and the EPPO’s novel nature as the first EU body with criminal prosecution tasks. This article sets off the Commission’s initial negotiation objectives against the results and future outlook of their mutual cooperation.

Artikel: Reflections on the place of criminal law in the European construction

Although the place of EU criminal law in the European construction has become incontestable today, it has historically been a far from obvious one. In its origins and development, two different rationales can be distinguished: a functional one aimed at using criminal law instruments to address specific cross-border crime challenges generated or enhanced by the progress of EU integration in other fields, and a constitutional one implying the use of criminal law also to further enhance the respect and promotion of EU common values. While the first rationale has been dominant from the outset, the second has emerged only gradually. For the sake of effectiveness, legitimacy and mutual trust, both rationales should equally drive the further development of EU criminal law. Yet prospects for a stronger affirmation of the constitutional rationale are weakened by current EU rule of law and democratic leadership challenges.

Boete van AP voor Politie voor ontbreken risicoanalyse camera-auto’s Rotterdam

De Autoriteit Persoonsgegevens (AP) legt de politie een boete op van 50.000 euro. Tijdens corona zijn in Rotterdam camera-auto’s ingezet, zonder dat hiervan eerst de privacyrisico’s in kaart waren gebracht. Met de rondrijdende auto’s zijn gedetailleerde beelden van mensen verzameld en opgeslagen. Uit onderzoek van de AP blijkt bovendien dat er te veel beelden werden gemaakt die niet noodzakelijk waren. Voor die overtreding kan de AP echter geen boete opleggen.
