Artikel: Materieel verkeersstrafrecht

In het proefschrift, dat de auteur in september 2024 heeft verdedigd, is onderzoek gedaan naar de verhouding tussen het commune en bijzondere materiële strafrecht. Die verhouding heeft de auteur onderzocht vanuit het perspectief van het codificatiebeginsel (dat neergelegd is in artikel 107 Grondwet), met een focus op het legaliteitsbeginsel en het schuldbeginsel. In dit onderzoek kwam naar voren dat het verkeersstrafrecht – als onderdeel van het bijzonder strafrecht – een terrein is dat weliswaar aansluit op het commune strafrecht, maar dat tegelijk een voedingsbodem is voor nieuwe materieelrechtelijke figuren en ontwikkelingen op het terrein van de schuldvormen. De ontstane nouveautés werken bovendien in meer of mindere mate door in het commune strafrecht. De in artikel 107 Grondwet en artikel 91 Sr tot uitdrukking gebrachte verhouding tussen het Wetboek van Strafrecht en de bijzondere strafwetten, waarbij het bijzonder strafrecht een volgzame (artikel 91 Sr) uitzondering (artikel 107 Grondwet) is op het algemene kader van materieel strafrecht in het Wetboek van Strafrecht, verdwijnt hierdoor naar de achtergrond. Dit komt de met het codificatiebeginsel beoogde samenhang en eenvormigheid binnen het gehele materiële strafrecht niet ten goede. In deze bijdrage licht de auteur enkele onderdelen van zijn promotieonderzoek uit, waarbij hij ook jurisprudentie betrekt die nadien gewezen is.

Proefschrift: Bewijsrecht in fiscale bestuurlijke boetezaken

De fiscale bestuurlijke boete vormt een merkwaardig fenomeen binnen het Nederlandse recht. Enerzijds is het een bestuursrechtelijke sanctie; anderzijds heeft zij door haar strafkarakter ook een sterke affiniteit met het strafrecht. Deze hybride aard plaatst de fiscale bestuurlijke boete op het snijvlak van het bestuursrecht en strafrecht, wat leidt tot tal van complexe en fundamentele rechtsvragen. De kernvraag die in dit proefschrift van Arjan Heidekamp (RUG) centraal staat, luidt: in hoeverre is het nationale bewijsrecht, zoals dat geldt voor fiscale bestuurlijke boetes, in overeenstemming met de waarborgen van artikel 6 EVRM?

Artikel: Protecting EU Taxpayer Money together with Global Partners

The European Anti-Fraud Office was created 25 years ago, in 1999, to fight fraud, corruption, and any other illegal activities affecting the EU budget. While there are several anti-fraud actors at EU level, OLAF is unique with regard to its international activities. In particular, OLAF is mandated to conduct investigative activities directly on territory outside the EU. Against this background, the article traces the evolution of the EU legal framework for OLAF’s international investigations and the parallel development of OLAF’s international relations in practice. The analysis of OLAF’s engagement with international partners focuses on several key activities of the Office to protect EU funds abroad, especially negotiating anti-fraud provisions in international instruments, concluding administrative cooperation arrangements with non-EU countries and international organisations, and building networks of partners around the globe. Looking back at the past quarter of a century, the article demonstrates that many features which are hallmarks of OLAF’s international relations today can be traced back to the early years of the Office. The article also shows how these practices have grown and matured over time.

The Protection of Fundamental Rights and Procedural Guarantees in OLAF Investigations: a 25-Year Journey

The protection of fundamental rights and procedural guarantees in administrative investigations conducted by the European Anti-Fraud Office (OLAF) has constantly evolved since its creation in 1999. First, the catalogue of procedural rights and guarantees embedded in the successive regulations governing the conduct of OLAF’s investigations was significantly expanded. Second, the existing mechanisms to ensure their protection were reinforced by the creation of the new function of the Controller of procedural guarantees and a new complaints mechanism. As a result, the legal framework under which OLAF operates at present is significantly more protective of fundamental rights and procedural guarantees than it was 25 years ago. This article sheds light on these two key developments: the progressive codification of fundamental rights and procedural guarantees applicable to OLAF’s investigations and the reinforcement of their protection by the creation of the new Controller and the new complaints mechanism.

In today’s fast-changing world, the issue of digitalisation – or “tech” – is rapidly moving up the agenda. This observation also very much applies to the anti-fraud domain. On the occasion of the 25th anniversary of the European Anti-Fraud Office (OLAF) in 2024, this article provides a retrospective of the progressive digitalisation of work at the Office. Arriving at today’s “digital first” paradigm has been a long journey since OLAF’s humble digital beginnings in 1999. The authors also review the parallel evolution of OLAF’s legal framework for data collection and data processing, and they offer some reflections on further digital challenges ahead.

Artikel: 25 Years of OLAF: Looking Back and Ahead

The article examines the evolution of the European Anti-Fraud Office over the past 25 years from its establishment in 1999 to its current role as a pivotal player in the fight against fraud affecting the EU’s financial interests. It starts by tracing OLAF's origins to its predecessor, the Unit for the Coordination of Fraud Prevention, and the circumstances surrounding OLAF’s creation as a response to major corruption scandals. The article goes on to analyse the legal framework underpinning OLAF’s mandate, in particular Regulation No. 883/2013 and Directive 2017/1371 on the fight against fraud to the Union’s financial interests by means of criminal law, which expanded OLAF's scope and facilitated its cooperation with the European Public Prosecutor’s Office. Furthermore, OLAF's evolving relationship with the EPPO is explored and significant case law that has shaped OLAF’s investigative powers and procedural safeguards highlighted. The article concludes by reflecting on OLAF’s achievements and the challenges it faces in combating fraud in an increasingly complex and multifaceted international financial landscape.

Artikel: Taak en verantwoordelijkheid van bestuurders en commissarissen voor mensenrechten, milieu en klimaat

De EU Corporate Sustainability Due Diligence Directive is in essentie een beleidsdocument, zo zal ik hierna betogen en illustreren. Het doel van de CSDDD is dat ondernemingen mensenrechten, milieu en klimaat nadrukkelijk in hun beleidsafwegingen betrekken. Wat betreft mensenrechten en milieu gaat het dan met name om praktijken die zich buiten de EU afspelen onder het oog van aldaar gevestigde dochtervennootschappen en zakenrelaties in de activiteitenketen. De CSDDD introduceert een zorgplicht voor grote ondernemingen om te achterhalen of aldaar sprake is van inbreuken op mensenrechten en milieu en, als dat het geval is, zich in te zetten om daar via de band die er met die 'buitenlandse' ondernemingen bestaat, iets aan te doen.

Artikel: De implementatie van het civielrechtelijke aansprakelijkheidsregime onder de CSDDD

De Corporate Sustainability Due Diligence Directive verplicht rechtspersonen – kort gezegd – om negatieve effecten op mensenrechten en milieu te identificeren en aan te pakken. De kern van deze bijdrage richt zich op het civielrechtelijke aansprakelijkheidsregime, opgenomen in artikel 29 CSDDD, en de implementatie daarvan in de Wet internationaal en verantwoord ondernemen. De Nederlandse wetgever implementeert de CSDDD ‘zuiver en lastenluw’. Dit brengt met zich mee dat het aansprakelijkheidsregime ex artikel 29 CSDDD grotendeels wordt geïmplementeerd over de band van de reeds bestaande artikelen 6:162 en 6:163 BW. Hiermee slaat de wetgever een bekende weg in, maar een nadere analyse van artikel 29 CSDDD en de implementatie daarvan laat zien dat er nieuwe obstakels zijn, waarmee partijen en rechters mogelijk geconfronteerd zullen worden.

Proefschrift: Betrouwbaarheid van getuigenverklaringen in het strafrecht

Getuigenverklaringen spelen een centrale rol in strafzaken, maar hun betrouwbaarheid is niet vanzelfsprekend. Uit rechtspsychologisch onderzoek blijkt dat getuigen onderhevig zijn aan talloze beïnvloedende factoren. Fouten kunnen ontstaan tijdens het waarnemen van een gebeurtenis, het opslaan van herinneringen, of het reproduceren ervan. Bovendien is het mogelijk dat getuigen bewust onjuiste informatie verstrekken. Indien de rechter een onware getuigenverklaring als bewijs toelaat, kunnen fatale fouten optreden: een schuldige verdachte wordt vrijgesproken of een onschuldige veroordeeld. Kesteloo onderzoekt daarom in haar proefschrift hoe het Nederlandse strafrecht omgaat met deze risico’s, en in hoeverre het systeem getuigenverklaringen betrouwbaar en eerlijk weet te benutten.

Het klimaattransitieplan: over de implementatie van artikel 22 CSDDD in de Wivo

In deze bijdrage staat het klimaattransitieplan centraal. Het Nederlandse conceptwetsvoorstel ter implementatie van de Corporate Sustainability Due Diligence Directive, de zogeheten Wet internationaal verantwoord ondernemen, verplicht zeer grote ondernemingen om een klimaattransitieplan op te stellen en naar beste vermogen uit te voeren. De belangrijkste verplichting voor een onderneming is om in haar transitieplan vast te stellen hoe zij haar bedrijfsmodel en -strategie in lijn brengt met de beperking van de opwarming van de aarde tot 1,5 °C in overeenstemming met de Overeenkomst van Parijs. In deze bijdrage worden de inhoudelijke vereisten van het klimaattransitieplan besproken aan de hand van voorbeelden en een aantal kernbegrippen toegelicht.
