With the Modernisation of the Code of Criminal Procedure, certain digital investigation powers will for the first time be given a specific statutory basis, such as the search of data carriers, open-source investigation and network searches. Nevertheless, considering the high degree of intrusiveness of such techniques, particularly with the right to privacy, it remains important to take note of the jurisprudence of the European Court of Human Rights, which continues to set minimum safeguards for the interference with private life. In this paper, we therefore conduct a brief overview of recent ECtHR case law concerning five types of digital investigation powers.

Media vormen een belangrijke informatiebron voor burgers over criminaliteit. Dit onderzoek toont aan dat mediaberichtgeving en angst voor criminaliteit niet losstaan van elkaar. Aangezien fakenewsberichten zich via (sociale) media verspreiden, rijst de vraag wat de relatie is tussen (de perceptie van) fake news en angst voor criminaliteit. Vooralsnog werd hieromtrent geen grootschalig en representatief onderzoek gevoerd. Deze studie baseert zich op een representatieve bevolkingsbevraging uit 2019.

Criminologists have frequently debated whether offenders are specialists, in that they consistently perform either one offense or similar offenses, or versatile by performing any crime based on opportunities and situational provocations. Such foundational research has yet to be developed regarding cybercrimes, or offenses enabled by computer technology and the Internet. This study address this issue using a sample of 37 offender networks. The results show variations in the offending behaviors of those involved in cybercrime. Almost half of the offender networks in this sample appeared to be cybercrime specialists, in that they only performed certain forms of cybercrime.
