In deze uitspraak beslist het ECJ dat het confisqueren (verbeurdverklaren) van een hulpmiddel dat toebehoort aan een derde die te goeder trouw is, in strijd is met het Europese recht. Bovendien is onrechtmatig dat het nationale recht niet voorzag in rechtsmiddelen ten gunste van deze derde.
